In the event of a death caused by the negligence or misconduct of another, Kentucky law allows the decedent’s estate to recover damages. Damages for wrongful death may be limited to burial expenses and the destruction of the decedent’s power to earn money. However, in some cases, medical bills and other losses can be recovered.
When a spouse, parent, or minor child is killed, Kentucky law allows the surviving family members to make a claim for the loss of the child’s affection and companionship. Kentucky law also allows a minor child to make a claim for the death of a parent.
